These Terms of Use ("Terms") form the End User License Agreement between you and Bolder Apps LLC ("we", "us", "our") governing your use of the Deep Nutrition mobile application ("the App"). By downloading, installing, or using the App you agree to these Terms. If you do not agree, do not use the App.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control, for personal, non-commercial use. All rights not expressly granted are reserved to us.
You agree not to: (i) copy, modify, reverse-engineer, decompile, or create derivative works of the App; (ii) rent, lease, sub-license, distribute, or sell the App; (iii) use the App in violation of any law or third-party right; (iv) attempt to gain unauthorized access to our systems or interfere with the App's operation; (v) upload malicious code or data.
Deep Nutrition is a nutrition and wellness tracking tool for informational and educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you have regarding a medical condition, medication, diet, or nutrition. Never disregard professional medical advice or delay seeking it because of information in the App. If you think you have a medical emergency, contact your doctor or emergency services immediately.
The App offers auto-renewable subscriptions:
Payment is charged to your Apple ID account at confirmation of purchase. Automatic renewal: subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price you agreed to.
Managing and cancelling: you can manage your subscription and turn off auto-renewal at any time in your Apple ID Account Settings after purchase. Cancellation of the current subscription is not allowed during the active subscription period; access to paid features continues until the end of the current billing cycle.
Free trials: any unused portion of a free trial period will be forfeited when you purchase a subscription.
Refunds are handled by Apple. Request a refund at reportaproblem.apple.com.
Your use of the App is also governed by our Privacy Policy, which describes what data we collect, how we use it, and your rights.
The App, its content (including text, graphics, logos, icons, images, audio, and code), and all related trademarks are owned by or licensed to Bolder Apps LLC and are protected by copyright and trademark laws. You may not use our trademarks without our prior written consent.
The App integrates with third-party services (Apple StoreKit, Apple HealthKit, Twilio, Firebase, AWS, USDA FoodData Central, Open Food Facts, and others described in our Privacy Policy). Your use of those integrations is subject to the terms of the respective providers. We are not responsible for the content, accuracy, or availability of third-party services.
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of the nutritional or scoring information displayed. We do not warrant that the App will be uninterrupted, error-free, or free of viruses.
To the maximum extent permitted by law, Bolder Apps LLC and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or health outcomes) arising from or related to your use of the App, even if advised of the possibility of such damages. Our aggregate liability for any claim arising from or related to these Terms or the App shall not exceed the amount you paid us for the App in the twelve months preceding the claim, or US$50, whichever is greater.
You may stop using the App at any time. We may suspend or terminate your access to the App if you breach these Terms or use the App in a manner that could cause harm to us, other users, or third parties. Sections that by their nature should survive termination will survive.
We may update these Terms from time to time. Material changes will be announced inside the App or by email. Continued use of the App after changes take effect constitutes your acceptance of the updated Terms. The "Last updated" date above always reflects the current version.
These Terms are governed by the laws of the jurisdiction in which Bolder Apps LLC is incorporated, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction, except where local consumer-protection law grants you rights to a different forum.
