Terms of Service for DN App
Introduction and Definitions
Welcome to DN App (“DN”). These Terms and Conditions of Use (“Terms”) constitute a legal agreement between you (“User,” “you,” or “your”) and Deep Nutrition LLC, including its subsidiaries and affiliated entities (collectively referred to as “DN App,” “we,” “us,” or “our”). These Terms govern your use of the DN App website, its mobile application, and its services (collectively, the “Service”), and you agree to be bound by them when you access, download, or use any part of the Service.
This includes, without limitation, your use of DN’s nutrition-related features under the following plans, based on user feedback and the app’s current features:

- Hydration logging (urine color)
- Fasting tracking
- Food logs showing real-time macro analysis
- Smart food scanning
- Caffeine tracking
- Micronutrient breakdown

- Personalized recommendations
- Top Nutrition Badges & Leaderboards
- Professional plan:
- All Premium features
- Multi organ-specific scores
- Deficiency alerts + excess alerts + dietary trends
- Organ-specific recommendations
This also includes, without limitation, your use of DN’s nutrition-related features such as macro analysis (carbohydrates, fats, protein) with calorie counting, hydration recording (including hydration/urine-color logging), fasting tracking, food logs showing real-time macro analysis, scanning food (Scanning food), caffeine tracking, detailed analysis (micronutrients / Micronutrient breakdown), weekly nutrition scores, monthly smart reports, personalized recommendations to improve your overall nutrition score, Top Nutrition Badges and leaderboards, multiple organ-specific nutrition scores (Multi organ-specific scores), deficiency alerts + excess alerts + dietary trends and recommendations to improve a specific organ of your choice (Organ-specific recommendations).
The minimum age to subscribe to or use the Service, including when subscribing to paid plans (the Premium plan or the Professional plan) or signing in as a free Freemium user, is 18 years, as determined strictly according to the date of birth you enter via the app at the time of subscription or account creation.
“Content” includes, without limitation: text, information, data, audio, video, images, designs, recipes, exercises, nutritional information, and all associated intellectual property rights, whether owned by DN App or created by users. For clarity, “Content” also includes all outputs, scores, reports, recommendations, and analyses generated by the Service from your recorded data, including macro and micronutrient analytics (Macro + calorie analysis and Micronutrient breakdown), food logs showing real-time macro analysis, hydration (including hydration/urine-color logging), fasting, caffeine-tracking data, weekly nutrition scores, organ-specific nutrition scores (Multi organ-specific scores), deficiency alerts + excess alerts + dietary trends and any monthly smart reports or personal or smart recommendations, or Organ-specific recommendations, as well as any other outputs related to Top Nutrition Badges and leaderboards, or features available under the Freemium, Premium, or Professional plans.
DN App bases its nutritional analytics and nutrient breakdowns on more than one approved database, including global databases such as the United States Department of Agriculture (USDA) database and other international food databases, in addition to a local database owned by DN App (the “local database”). This local database is designed to include—as far as possible—traditional and popular dishes and meals common across the Arab world, including foods that may not be covered in well-known global food databases. DN App has exercised the highest degree of professional care and diligence in building this local database and in documenting and detailing the ingredients and nutritional values of each traditional or popular meal, with the aim of making it one of the most comprehensive food databases in the Arab world.
However, the nutritional values in this local database, like the values derived from other databases such as USDA, remain estimates and are subject to updates, and may at any time be revised or modified in the future based on scientific updates, research, studies, improvements in measurement methodologies, or data sources. Any reliance on these values or food tables does not constitute a legal guarantee or a commitment of absolute accuracy, and the user acknowledges that these data may be modified or updated without any prior individual notice, as part of improving the quality of the Service and complying with applicable scientific and regulatory best practices.
DN App strives to be the most accurate application in its nutrient calculations (including Macro + calorie analysis and Micronutrient breakdown) and in computing weekly nutrition scores and organ-specific nutrition scores, compared to other available nutrition and wellness applications. However, as with similar applications, there are limitations on accuracy due to numerous detailed factors beyond DN’s control, including but not limited to: variation between the actual nutritional values of the same meal or fruit and the values listed in food databases (for example, a fruit in the database may be listed with certain quantities of nutrients, whereas actual quantities may differ up or down depending on soil, growing region, storage method, preparation, and other factors), as well as user logging behavior, human estimation of portion sizes, errors in food scanning (taking photos of food), and the freshness of data sources. Accordingly, everything calculated by the Service is an estimate based on the available nutritional information and the records you enter into the app, and cannot be considered a definitive laboratory or medical measurement.
You acknowledge and agree that any updates, refinements, or expansions to these underlying food and nutrient databases (whether by adding more items, adjusting nutrient breakdowns, or improving measurement methodologies) may lead to corresponding adjustments in the outputs generated by the DN App Service, including but not limited to comprehensive nutrient insights (CNI scores), weekly nutrition scores, and organ-specific nutrition scores (Multi organ-specific scores). Such updates are implemented to enhance scientific accuracy and keep your scores as reflective as possible of current knowledge, and may therefore cause your future scores, trends, or related insights to change slightly over time, even if your logged eating patterns remain similar. By continuing to use the Service, you consent to DN App applying these database improvements automatically and on an ongoing basis, as part of our commitment to provide you with more precise and meaningful nutritional intelligence, while always treating your data and results with respect for your values, privacy, and the importance of consistent weekly score monitoring.
“User-Generated Content” (“UGC”) means any data, text, images, audio, video, reviews, comments, or any other content that you upload, submit, or transmit via the DN App Service. UGC explicitly includes any food intake logs, hydration entries (including hydration/urine-color logging), fasting periods, caffeine-consumption records, biometrics, goals, preferences, and any other health- or wellness-related information you provide for purposes of macro/micro analysis, score calculation (including weekly nutrition scores and Multi organ-specific scores), reporting (such as monthly smart reports), recommendations (including personalized recommendations and Organ-specific recommendations), or participation in Top Nutrition Badges and leaderboards.
Food Items Subject to Local and International Legal and Cultural Requirements
Without prejudice to the generality of the foregoing definitions of “Content” and “User-Generated Content”, and recognizing that DN App will initially launch and operate in the Kingdom of Saudi Arabia and the Gulf region before expanding to additional jurisdictions worldwide, you expressly acknowledge and agree that: (a) the food databases and logging tools made available within the Service may include, now or in the future, items and recipes containing ingredients such as alcohol, whisky, pork or pork derivatives, and other foods or beverages that may be considered sensitive, restricted, or non-compliant with certain local cultural, ethical, or legal standards (“Sensitive Items”); (b) DN App provides the ability to search, view, and log such Sensitive Items solely for neutral nutritional-intelligence, tracking, and analytical purposes, and does not, by listing or allowing you to log any such item, promote, encourage, market, or endorse its purchase, preparation, serving, or consumption in any specific territory; (c) you remain solely responsible for ensuring that any food or beverage you choose to purchase, prepare, serve, consume, or log through the Service (including any Sensitive Items) is lawful and compliant with all laws, regulations, public-order rules, and mandatory cultural or ethical standards applicable in the place where you are located or to which you are subject (including, without limitation, the laws and regulations of the Kingdom of Saudi Arabia when you are located in or otherwise subject to KSA jurisdiction); (d) DN App may, at its sole discretion and without liability, adapt the visibility, searchability, labeling, warnings, or availability of certain Sensitive Items (for example, alcohol-, whisky-, or pork-based entries, or other non-standard foods) for some users, regions, or languages in order to comply with applicable local laws and regulations, platform rules, or public-order requirements, including those in the KSA and the Gulf, while continuing to provide appropriate logging capabilities for international subscribers and users in other jurisdictions, all without creating separate or conflicting terms of service; and (e) nothing in these Terms shall be interpreted as granting you any right to use the Service in a manner that would violate any applicable local, national, or international law, and DN App reserves the right to rely on geo-location, app settings, content filters, or other reasonable technical or organizational measures to balance compliance with KSA law, Gulf-region regulations, and international legal standards with the ability of global users to log their actual nutrition intake. You further agree that you will not use any feature of the Service to circumvent or undermine such measures, and that, where a particular Sensitive Item is hidden, filtered, or restricted in your interface, you will refrain from attempting to access or log it in a way that conflicts with the applicable law in your jurisdiction.
Past Nutrition Intake and Lab Test Results
The DN App Service helps you track your food intake over time and highlights possible nutrient excesses or deficiencies based on your ongoing logging. You expressly acknowledge and agree that, when you first start using the Service, your body may already have nutrient imbalances caused by your past lifestyle and intake over months or years before using DN App.
Because some laboratory tests mainly reflect this past intake rather than recent changes, you further acknowledge and agree that:
(a) any lab results after you start using the Service does not prove that DN App’s directions, scores, or suggestions are unhelpful or incorrect;
(b) Deep Nutrition LLC is not responsible or liable for any excesses, deficiencies, or imbalances in nutrients or elements shown in any external test, check-up, or analysis you perform at any time, including during your subscription.
(c) changes in the body’s nutrient levels usually happen slowly over longer periods, so DN App only provides forward-looking guidance and estimates based on your logged data and does not guarantee “normal range” results in any laboratory.
You therefore agree not to use any such lab or measurement results, on their own or together with your use of the Service, as legal evidence that DN App’s directions, suggestions, or recommendations are ineffective or misleading, without prejudice to any mandatory rights that cannot be waived under applicable law.
Compliance with SDAIA and Local Data Regulations
Where applicable, DN App collects, processes, stores, and transfers personal data in accordance with the laws and regulations of the Kingdom of Saudi Arabia, including the requirements and guidelines issued by the Saudi Data and Artificial Intelligence Authority (SDAIA) and any applicable Personal Data Protection Law (PDPL). DN App undertakes to: (a) limit the collection of personal data to what is necessary to provide, improve, and enhance the Service and its features (including analytics, reports, and recommendations, such as monthly smart reports, weekly nutrition scores, deficiency/excess alerts and dietary trends, and personalized and organ-specific recommendations); (b) implement appropriate technical and organizational measures to protect personal data; (c) respect applicable user rights such as the rights of access, rectification, erasure, and objection, in accordance with SDAIA and PDPL requirements; and (d) obtain required consents, especially when the data are sensitive or health-related (including macro/micro data, hydration data, fasting, caffeine, and organ scores). Additional details are provided in our Privacy Policy, which forms part of these Terms.
You may not use DN App:
- To reverse engineer, modify, scrape, or create derivative works from any part of the Service.
- To collect or use data for training or improving AI models without explicit written consent.
- If you are under 18 years of age.
- To impersonate others, upload abusive or infringing content, or engage in harassment, discrimination, or illegal activity.
- To access the site by non-human means such as bots or scripts.
- To misuse or misrepresent any nutrition-related scores, reports, trends, or recommendations (including macro/micro analytics, Micronutrient breakdown, Multi organ-specific scores, deficiency alerts + excess alerts + dietary trends, weekly nutrition scores, monthly smart reports, personalized recommendations, and Organ-specific recommendations) as definitive medical diagnoses or treatments.
- To attempt to circumvent or interfere with any data, privacy, or security controls implemented in accordance with SDAIA, PDPL, or other applicable regulations.
Account Registration and Security
To access the full functionality of DN App, including Freemium features and the Premium and Professional plans, you must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
DN App reserves the right to suspend or terminate your account without prior notice in the event of a breach of these Terms, to comply with legal requests, or to protect the integrity of the Service. This includes, without limitation, misuse of macro or micro nutrient analytics, misuse of Freemium, Premium, or Professional features, manipulation of Top Nutrition Badges and leaderboards, or any misleading use of organ scores, deficiency or excess alerts, dietary trends, monthly smart reports, or organ-specific recommendations that may mislead other users or customers.
Service Changes and Availability
DN App may update, modify, suspend, or discontinue any part of the Service, distinguishing between free service (Freemium plan) and paid services (Premium and Professional plans). For free services, DN App may do so at any time without notice, while taking care not to compromise users’ core data. For paid services, DN App will make reasonable efforts to provide prior notice before any discontinuation or material modification that negatively affects core paid features during the paid subscription term, or to provide functionally equivalent alternatives or fair settlements in line with applicable regulations.
Without prejudice to the foregoing, DN App further reserves the right, at its sole discretion and without liability, to temporarily deactivate, suspend, or limit access to the Freemium plan (in whole or in part) at any time and without prior notice, including for technical, operational, or business reasons.
While we strive to maintain full availability and data stability, DN App makes no guarantees regarding availability, uninterrupted operation, or data accuracy. Certain features (such as Freemium benefits, or Premium plan functions including urine-color hydration logging, fasting tracking, food logs with real-time macro analysis, food scanning, Micronutrient breakdown, weekly nutrition scores, monthly smart reports, personalized recommendations, Top Nutrition Badges and leaderboards, or Professional plan features including Multi organ-specific scores, deficiency alerts + excess alerts + dietary trends, and Organ-specific recommendations) may be enhanced, added, or removed over time as the Service is improved or as required by changes in applicable laws or SDAIA guidelines.
If the Service is temporarily unavailable or a technical outage prevents you from entering your meal, nutrition, or health records in real time, you acknowledge and agree that one of the technical mechanisms available to maintain the accuracy of nutritional and health score calculations in DN App is your ability, at a later time, to go back to previous dates (such as the previous day, the prior two days, three days, or any other time window the app allows) to enter, complete, or modify your meal inputs and related data for those dates, once the Service has returned to normal operation. Your use of the allowed back-dating feature to enter, complete, or modify your data for that period forms part of your obligation to cooperate with the app to ensure the accuracy of the estimates, results, and nutrition and health scores that the Service calculates based on your records. DN App shall not incur any additional obligation to compensate for a temporary outage so long as such outage remains within reasonable limits and does not contravene applicable regulations.
Premium and Professional Services and Payments
DN App offers free and paid subscription options, including:
- Freemium plan: provides free access to Macro + calorie analysis.
- Premium plan : provides all Freemium features plus hydration recording (urine color), fasting tracking, food logs showing real-time macro analysis, smart food scanning food, caffeine tracking, Micronutrient breakdown, weekly nutrition scores, monthly smart reports, personalized recommendations, Top Nutrition Badges and leaderboards.
- Professional plan: provides all Premium features plus Multi organ-specific scores, deficiency alerts + excess alerts + dietary trends, and Organ-specific recommendations.
Paid services may include advanced features, analytics, and specialized tools as described above. Subscriptions renew automatically unless canceled before the end of the current billing cycle. By providing your payment details, you authorize DN App or its payment processor to charge the applicable fees for your selected plan—whether upgrading from Freemium to a paid plan, Premium, or Professional. We reserve the right to change prices and will notify you in advance of such changes. Some features—such as advanced micronutrient analytics, deeper organ scores, extended historical dietary trends, enhanced monthly smart reports, excess alerts, and Organ-specific recommendations—may only be available in specific paid tiers or bundles within the Premium or Professional plans.
No refunds are provided for partial use or early termination of paid Service subscriptions, whether monthly or annual (paid in advance). All subscriptions are deemed due and non-refundable once the subscription term starts or once any part of the Service is used during the subscription period, including the use of any features of the Premium plan or the Professional plan during the subscribed month or year, and the subscriber is not entitled to claim a refund of any portion of the fees for the remaining period of the relevant billing cycle. “Partial use” means benefiting from the Service during only part of the subscription term (such as one month of an annual subscription), and “early termination” means requesting cancellation of the subscription before the end of the billing term.
“Cancellation before commencement” refers to situations where the subscription fee is paid in advance (monthly or annually) and the subscriber then requests cancellation before the actual activation date. In this case only, cancellation and a refund of the paid amount may be requested, provided that a written request is sent to DN App support via the email address specified in these Terms, at least thirty (30) days before the subscription start date for annual subscriptions or seven (7) full days before the subscription start date for monthly subscriptions. In such cases, a non-refundable reservation fee (deposit) of ten percent (10%) of the total value of the cancelled subscription will be deducted, and the remaining amount will be refunded in accordance with the mechanisms and timeframes determined by the payment service provider.
If a cancellation request is submitted after the subscription has commenced or after any part of the paid Service has been used, the subscription will be considered fully due for the billing cycle (monthly or annual), and the subscriber will not be entitled to a refund of any part of the fees. With respect to early termination after commencement, no refund will be accepted except in exceptional cases expressly provided for in these Terms or in specific offers or subscription documents for each Service, and only on condition that the early termination request is submitted during the current billing period and before it ends, and that a written refund request is sent to DN App support via the specified email within a maximum of seven (7) days from the date of early termination for a monthly subscription, or thirty (30) days from the date of early termination for an annual subscription or from the date of occurrence of the reason on which the claim is based, whichever is earlier. The beneficiary’s right to any refund will be definitively forfeited upon the expiry of these periods without submitting the request in accordance with the specified procedures.
In all cases, if the offers or subscription documents specific to any Service provide for entitlement to a full or partial refund, any refundable amounts (if any) will be calculated based on time ratios, the volume of actual usage, or any other objective criteria set out in those offers or documents, without relying solely on a general reference to “the applicable system.” Nothing in this section shall prejudice any mandatory rights granted to you under applicable laws, regulations, and rules that cannot be waived or contracted out of, and no provision of these Terms, offers, or subscription documents may be interpreted in a way that diminishes such fundamental statutory rights of the user, even if not expressly mentioned.
Promotional codes and trial offers are subject to separate terms and limits and may be revoked at any time.
Top Nutrition Badges
Within certain paid plans (such as the Premium and Professional plans), DN App offers a feature called “Top Nutrition Badges and leaderboards” Through this feature, badges are displayed for up to the top five (5) subscribers in each category available in the app, based on objective criteria set by the app, such as the overall nutrition score of a Premium subscriber and/or Multi organ-specific scores and other nutrition scores available within the Professional plan, or any other scores adopted by the app. DN App may, at its sole discretion, modify the number of honorees, eligibility criteria, and covered categories at any time, without incurring any obligation toward users.
Display of Name and Image in Leaderboards and Top Nutrition Badges
By using the “Top Nutrition Badges and leaderboards” feature, you agree that DN App may display your name or username within the lists, badges, or rankings associated with these features. If you do not wish your full name to be displayed, you may choose to show only the initials of your three-part name (for example, the first letter of your first name, father’s name, and family name), and for consistency and privacy protection the app may automatically generate and display these initials instead of your full name.
You may also, optionally and without obligation, add a profile picture to be displayed alongside your name or initials in these lists, and you fully undertake not to use any image that violates applicable law or infringes the rights of others. DN App reserves the right to hide or delete any image it deems inappropriate.
Use of Winners’ Names and Titles in Marketing Campaigns and Social Media
By using the app and accepting these Terms, you grant DN App a worldwide, non-exclusive, revocable license to use, display, and republish your name as displayed in the app (or your initials, if you choose that option), your profile picture (if any), and your ranking and/or receipt of “Top Nutrition Badges and leaderboards”, in the app’s marketing and promotional materials, including but not limited to social media, the website, presentations, and digital advertisements, for the purpose of marketing and promoting DN App’s services and highlighting user success stories and results, without any financial consideration or compensation to you, and without prejudice to DN App’s statutory obligations in the area of data protection and privacy.
You may request to restrict such use in circumstances permitted by law and to the extent that such restriction does not conflict with applicable statutory or contractual requirements, via the contact channels specified in these Terms.
Intellectual Property
All trademarks, logos, content, and technologies owned by DN App and its licensors remain the exclusive property of DN App and its licensors. You may not use any of these materials without prior written consent. This includes any proprietary algorithms, scoring methodologies, data visualizations, or analytical models used to generate macro/micro analysis, Macro + calorie analysis, Micronutrient breakdown, weekly nutrition scores, nutrition scores, Multi organ-specific scores, deficiency alerts + excess alerts + dietary trends, monthly smart reports, Top Nutrition Badges and leaderboards, and personalized and organ-specific recommendations.
By submitting User-Generated Content (UGC), you grant DN App a perpetual, royalty-free, sublicensable license to use, display, modify, and distribute your UGC for purposes of operating and promoting the Service. You also waive any moral rights in your UGC to the extent permitted by law. Subject to applicable data protection requirements and SDAIA/PDPL rules, DN App may convert your UGC into anonymized or aggregated datasets to improve features such as the accuracy of macro/micro analysis, Macro + calorie analysis, Micronutrient breakdown, organ-score models, deficiency and excess detection, dietary trend analysis, and engines for personalized and organ-specific recommendations.
Privacy and Data Use
Your privacy is important to us. By using DN App, you agree to our collection and use of your information as described in our Privacy Policy.
We process and store personal data in accordance with relevant privacy laws. DN App may share anonymized or aggregated data for research, improvement, or commercial purposes, including improving the accuracy of nutrient calculations, weekly nutrition scores, organ scores, deficiency/excess alerts and dietary trends, and developing monthly smart reports and personalized and organ-specific recommendations. Personal data will not be sold or disclosed without a legal basis or user consent.
Where SDAIA, PDPL, HIPAA, GDPR, or other local and international regulations apply, DN App will restrict cross-border data transfers, implement data localization requirements where imposed, and respect applicable rights relating to your personal and health data. Health and nutrition information you log (including macro/micro data, Macro + calorie analysis, Micronutrient breakdown, hydration including urine color, fasting, caffeine consumption, weekly nutrition scores, organ scores, and deficiency alerts + excess alerts + dietary trends) is treated as sensitive information and handled with heightened protection in accordance with applicable law.
Third-Party Services and Content
DN App may provide links or access to third-party websites, services, or content. We do not endorse or control these third parties and are not responsible for their content, privacy policies, or practices. Your use of third-party services is at your own risk. Any third-party integrations that interact with your data in DN App (such as importing food logs or exporting reports related to weekly nutrition scores, organ scores, or monthly smart reports) are used at your discretion, and you are responsible for reviewing and accepting any applicable third-party terms.
Disclaimers and Limitations
All content and services provided through DN App, including features under Freemium, Premium, and Professional, are for informational purposes only and do not constitute medical advice. You must always consult a healthcare provider before taking any action based on nutritional, medical, or fitness content, or based on weekly nutrition scores, organ scores, deficiency or excess alerts, dietary trends, or personalized or organ-specific recommendations.
Statements by DN App have not been evaluated by any food and drug authority and are not intended to diagnose, treat, cure, or prevent any disease. The information, including results of Macro + calorie analysis, Micronutrient breakdown, weekly nutrition scores, organ scores, deficiency/excess alerts and dietary trends, monthly smart reports, and personalized or organ-specific recommendations, is not intended as a substitute for medical consultation, diagnosis, or treatment by licensed professionals.
DN App is provided “as is” and “as available” without any warranty of any kind. To the fullest extent permitted by law, DN App disclaims all liability for all damages, including direct, indirect, incidental, or consequential damages, even if advised of their possibility. DN App’s total liability to you for any reason shall not exceed the amount you paid in the twelve months preceding the claim, or USD 100, whichever is greater. DN may, at its sole discretion, provide this compensation in the form of account credit or by extending your current subscription for one free month (or an equivalent value), instead of a cash payment.
No Warranties and User Responsibility
Please review this section carefully. By accessing or using DN App or any DN services, you confirm that you understand and accept the risks described below.
To the maximum extent permitted by applicable law, including any mandatory consumer protection rules, your access to and use of DN’s websites, mobile applications, platforms, tools, and any related or connected services (collectively, the “Services”) is entirely at your own discretion and risk. The Services (including, without limitation, DN’s nutrition-intelligence features such as macro and micro analysis, Macro + calorie analysis, Micronutrient breakdown, hydration and fasting tracking, caffeine tracking, weekly nutrition scores, monthly smart reports, organ scores, deficiency alerts + excess alerts + dietary trends, Top Nutrition Badge and leaderboards functions, and personalized and organ-specific recommendations generated by DN’s systems and algorithms) are provided on an “as is” and “as available” basis.
DN makes no promises, warranties, or representations, express or implied, of any kind regarding the Services, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, security, accuracy, or completeness. DN does not guarantee any specific health, wellness, weight, or performance outcome from using the Services, while remaining committed to delivering the Service according to best available technical practices and reasonable quality standards, and without prejudice to any mandatory contractual or legal obligations.
We do not undertake that the Services or any part thereof will operate without interruption, be delivered within a specific time, be secure or error-free, or be free of viruses, bugs, or other harmful components, and we accept no responsibility for data inaccuracies, logging errors, or service failures, without prejudice to any mandatory liabilities that cannot legally be excluded or limited.
You acknowledge and agree that:
Any data, visualizations, scores, analyses, dashboards, insights, advice, or materials you access via the Services (including, without limitation, macro and micronutrient information, Macro + calorie analysis, Micronutrient breakdown, hydration and fasting logs, caffeine-tracking outputs, weekly nutrition scores, monthly smart reports, deficiency alerts + excess alerts + dietary trends, Top Nutrition Badge and leaderboards outputs, organ scores, and personalized and organ-specific recommendations) are provided solely for general informational, educational, and self-tracking purposes.
DN does not tailor this information to your medical history, health condition, or specific nutritional needs unless expressly stated in a separate written agreement. You are solely responsible for assessing the accuracy, completeness, timeliness, and suitability of any content or metrics before relying on them or taking any action based on them. You understand that DN’s data and scores are derived from user inputs, third-party databases, and algorithmic models that may contain errors, omissions, or approximations.
Limitations of Digital Services and User Inputs – The use of DN’s digital nutrition and lifestyle tools, including Freemium, Premium, and Professional features, inherently involves uncertainties and limitations. These may include, for example, incomplete or outdated food databases, barcodes scanned incorrectly by the food-scanning feature, meals logged incorrectly in food logs showing real-time macro analysis, inaccurate portion estimates, connectivity interruptions, system maintenance windows, synchronization delays between devices, and reliance on information provided by you or other users.
By choosing to use DN App, you expressly accept that such limitations may affect the accuracy of your records, scores, and reports (including weekly nutrition scores, organ scores, and deficiency/excess alerts and dietary trends), and you agree that you (and not DN App) ultimately bear responsibility for any nutritional, lifestyle, or health decisions you make in light of the information or analyses displayed by the Services, without prejudice to your legal rights in the event of a material Service defect that constitutes a breach of DN’s legal or contractual obligations.
DN does not provide medical care, medical nutrition therapy, diagnosis, treatment, or any other regulated healthcare service. The content and Services are not intended to and must not be used as a substitute for professional advice, diagnosis, or treatment from a physician, dietitian, or any other licensed healthcare provider. This remains true even when the Services provide organ-specific nutrition scores, deficiency or excess alerts, dietary trends, personalized recommendations, or organ-specific recommendations targeting a particular organ or health focus that you choose.
You must always consult a qualified healthcare professional before: (a) starting, stopping, or modifying any diet; (b) changing fasting practices or hydration routines (including any decisions based on hydration/urine-color logging); (c) modifying caffeine intake; (d) starting or changing an exercise program; or (e) making any other decision that may affect your health, especially if you are pregnant, breastfeeding, have a chronic condition, or are taking prescription medications. Never ignore professional medical advice or delay seeking it because of information or scores you obtained through DN. In emergencies, contact your local emergency services immediately.
The Services may display, integrate, or link to content, products, professionals, applications, or services provided by third parties. DN does not own, operate, or control these third-party offerings and does not endorse, guarantee, or warrant any third-party information, qualifications, advice, recommendations, products, or services, whether appearing within or accessible via DN. Any communication, consultation, purchase, or other interaction you choose to have with third parties is solely between you and the third party. DN App is not responsible for any acts, omissions, errors, representations, warranties, breaches, or negligence of any such third parties, or for any personal injury, property damage, loss, claim, or expense arising out of or relating to your dealings with them.
By continuing to access or use the Services, you knowingly and voluntarily assume all risks associated with such use and agree that, to the extent permitted by applicable law, DN App, its affiliates, officers, employees, and licensors shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to these risks or your reliance on the Services. This disclaimer is binding upon you and your heirs, executors, administrators, successors, and assigns, and survives any suspension, termination, deactivation, or expiration of your account or use of the Services. Nothing in this section is intended to exclude or limit any rights or remedies that cannot legally be excluded or limited under applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless DN App, its parent entities, subsidiaries, affiliates, officers, directors, employees, contractors, licensors, and agents from and against any and all claims, suits, actions, damages, losses, liabilities, judgments, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your access to or use of the Services; (b) your breach or alleged breach of these Terms or any applicable law or regulation; (c) any content, data, or materials you provide, upload, transmit, or make available through the Services (including any data you enter into Freemium, Premium, or Professional features); or (d) your interactions with other users or third parties in connection with the Services.
Termination
You may stop using DN App and close your account at any time by following the instructions provided in the app or on the website, subject to any active subscription or contractual obligations related to the Freemium, Premium, or Professional plans.
DN App reserves the right, at its sole discretion and without liability, to suspend, restrict, deactivate, or terminate your account or access to any part of the Services at any time, with or without prior notice, if we believe that: (a) you have violated these Terms or any applicable law; (b) your conduct may harm DN App, other users, or third parties; (c) your account has remained inactive for at least 12 consecutive months, provided that termination is, where reasonably possible, preceded by notice sent to your registered contact details granting you a reasonable grace period to reactivate the account before termination; or (d) we have decided to discontinue all or part of the Services.
Upon any termination or deactivation of your account, your right to access and use the Services, including Freemium, Premium, and Professional features, ceases immediately. DN App may, however, retain UGC, activity logs, and other operational data for backup, security, business continuity, dispute resolution, and compliance with legal or regulatory requirements.
Retention and deletion of your personal data, including nutrition and health records, will be managed in accordance with our Privacy Policy and any applicable legal requirements, including, where relevant, those issued or overseen by SDAIA and the Saudi PDPL or other local data protection authorities. In some cases, we may anonymize your data so that it can no longer be linked to you, in which case we may use such anonymized data for research, analytics, or product improvement.
Governing Law and Dispute Resolution
These Terms, and any dispute, claim, or controversy arising out of or relating to them or to the Services or your use of DN App (whether in contract, tort, or otherwise), shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. The courts of the Kingdom of Saudi Arabia shall have jurisdiction—according to applicable jurisdictional rules—to hear and decide any dispute or claim between you and DN App relating to these Terms or the use of the Services. No mandatory arbitration mechanism applies unless expressly required by applicable law or by a separate written agreement between you and DN App.
Any amicable agreement or settlement reached between the parties does not affect either party’s right to resort to the competent courts in the Kingdom of Saudi Arabia if a final satisfactory settlement is not reached, without prejudice to any other mandatory statutory rights.
Amendments
DN App may update, revise, or replace these Terms from time to time to reflect changes in our Services (including changes to Freemium, Premium, or Professional features) or legal, regulatory, or business developments. Unless otherwise stated, amendments take effect 10 days after we publish the updated Terms within the Services or on our website.
Your continued access to or use of the Services after the effective date of any changes constitutes your agreement to be bound by the amended Terms from their effective date, it being understood that the Terms and Conditions form a mandatory framework for use of the Service and that acceptance or non-acceptance is not a purely optional matter affecting the continuation or cessation of the Service beyond what is determined by applicable law or required by your actual use of the Service.
If any changes materially affect how we collect, use, store, or share personal or health data, or significantly change how DN’s core features work (such as Macro + calorie analysis, Micronutrient breakdown, weekly nutrition scores, organ-score calculations, deficiency alerts + excess alerts + dietary trends, monthly smart reports, Top Nutrition Badge and leaderboards features, or personalized or organ-specific recommendations), we may provide notice (for example, via in-app notifications or email) and, where required by law or SDAIA/PDPL or similar authorities, seek renewed consent or provide you with specific options regarding such changes.
We may also roll out certain changes in phases or to specific user groups first, and your continued use of any new or modified feature after being notified will indicate your acceptance of the terms specific to that feature, within the limits permitted by applicable law.

These Terms constitute the entire agreement between you and DN App and supersede all prior agreements. If any part of these Terms is found invalid, the remainder shall remain enforceable. DN App’s failure to enforce any right under these Terms does not constitute a waiver of that right.
